Abstract: It is true that the Nigerian construction industry is in deep trouble and has not witnessed any real growth for some time now. It is also true that most of the value-added to construction is lost to the Nigerian construction industry. The contractual framework and procedures which are in practice in the Nigerian construction industry are not necessarilyadapted to the local needs of our industry. As a consequence the performance of the indigenous construction professionals is low. This paper looks at some of the issues involved in administering contracts under this environment and suggests that, the contract provisions must be seen for whatit really is, a guide.
